FAQ - Who We Work With
Problem
Scenarios - Are
you in any of these situations now?
- I've
just had a car accident and sustained serious injuries. Do I have a case?
- I
have been seriously hurt on the job and I know that, except
in certain limited circumstances, I cannot sue my employer. Can
I bring an action for money damages against any other individual
or entity to receive fair and adequate compensation for my injuries,
lost wages and medical expenses?
- I
tripped and fell on a defective walking surface (walkway, sidewalk, parking lot, carpet, tile, linoleum, asphalt,
concrete, blocks, etc.). Is it "my fault" or can I hold
individuals and/or entities accountable for money damages for
not having a safe place to walk?
- I've
been seriously injured by a product (for example, a home appliance, motor vehicle or piece of industrial
machinery) that was not reasonably safe for its intended purpose.
Despite the fact that it is widely distributed and sold, can I
maintain an action against the manufacturer and others in the
chain of distribution to recover money damages for my injuries?
- My
mother, father or other elderly relative or friend has sustained
serious injuries or medical conditions as a result of the
negligence of a nursing home and its staff. Can they be held accountable
for money damages as a result of neglecting their resident/patient?
- A
hospital, doctor or other medical professional has departed from
a reasonable standard of care in their treatment of a patient,
resulting in serious injuries or death. Despite the fact that
the medical professional meant no harm, can a lawsuit for money
damages be maintained against the hospital or doctor for economic
damages such as medical expenses and lost wages, pain and suffering
and loss of enjoyment of life?
"I'm
not that kind of person"
Many
people feel that if they are injured through the fault of others,
they wouldn't feel right or they are "not that kind of person"
who would make a claim or sue for their injuries. The insurance
industry and major corporations have done an excellent job of making
people feel guilty or uncomfortable -- as if they are doing something
unseemly -- about enforcing their legal rights and bringing a claim
or lawsuit for their injuries. However, in many instances where
one has been injured, a quick and thorough investigation by legal
and investigative professionals is necessary to properly preserve
evidence, take photographs and identify and take statements from
witnesses. This window is often small and requires immediate attention.
If you
have sustained injuries in an accident, you need a lawyer and you
need one now. There will be plenty of time later to decide whether
or not you want to press your case or claim. But if you do not act
quickly in retaining the right professional to protect your legal
interests at the outset, the opportunity to proceed with a claim
or lawsuit later may be lost forever.
